These terms govern use of the JTWS website. Client projects and paid services are governed by a separate proposal, statement of work or services agreement.

1. About JTWS

This website is operated by JTWS Web Solutions (“JTWS”, “we”, “us” or “our”).

2. Acceptance of these terms

By accessing or using this website, you agree to these terms. If you do not agree, you should stop using the website.

You must be at least 18 years old, or otherwise have legal capacity and any necessary authority, to submit a business enquiry or enter into an agreement with JTWS.

3. Website information is not a binding offer

The website provides general information about JTWS, its capabilities and previous work. It does not constitute a binding offer, technical specification, warranty, professional advice or commitment to accept a project.

No contract for paid services is formed merely because you use the website, submit an enquiry, receive an automated acknowledgement or discuss a potential project. A contract is formed only when the relevant parties agree written commercial terms, such as a proposal, statement of work or services agreement.

4. Permitted use

You may view and use this website for lawful personal or internal business purposes. You must not:

  • use the website unlawfully, fraudulently or in a way that infringes another person’s rights;
  • attempt to gain unauthorised access to the website, hosting environment, accounts or connected systems;
  • introduce malware, harmful code, excessive traffic or automated requests that impair normal operation;
  • scrape, harvest or extract substantial website content or contact information except where permitted by law;
  • misrepresent your identity or submit knowingly false, abusive or misleading information; or
  • use website content to imply an endorsement, partnership or association that does not exist.

We may restrict or block access where reasonably necessary to protect the website, users, systems or business.

5. Contact form and submitted material

You are responsible for ensuring that information submitted through the contact form is accurate, lawful and appropriate. Do not submit confidential source code, credentials, security keys, special-category personal data or third-party confidential information unless we have agreed a secure method and there is a legitimate need.

You retain ownership of material you submit. You grant JTWS a limited, non-exclusive permission to receive, copy, process and store that material as reasonably necessary to assess and respond to the enquiry, prevent abuse, maintain records and comply with law.

Submission of an enquiry does not create a duty of confidentiality unless a separate confidentiality agreement applies or confidentiality arises under applicable law.

6. Intellectual property

Unless stated otherwise, the website and its original content, branding, design, text, graphics and code are owned by or licensed to JTWS and are protected by intellectual-property laws.

You may print or save reasonable extracts for your own internal evaluation of JTWS services. You must not reproduce, republish, sell, license, modify or commercially exploit a substantial part of the website without prior written permission.

Client names, product names, trademarks and third-party materials remain the property of their respective owners. References to technologies or third-party services do not imply endorsement.

7. Portfolio and testimonials

Portfolio descriptions are provided to illustrate the general nature of work undertaken. Details may be abbreviated, anonymised or adapted to protect client confidentiality. They do not guarantee that another project will achieve identical results.

Testimonials reflect the views and circumstances of the relevant client at the time provided. Results depend on project scope, client inputs, third-party services and other factors.

8. Website availability and accuracy

We aim to keep the website available, secure and reasonably accurate, but do not guarantee that it will always be uninterrupted, error-free, current or free from harmful components.

We may alter, suspend or withdraw any part of the website without notice. You are responsible for using suitable security software, backups and independent judgment when acting on website information.

9. Third-party links and services

The website may contain links to, embeds from or references to third-party websites and services. We do not control them and are not responsible for their availability, accuracy, security, content or privacy practices. A link does not necessarily amount to endorsement.

10. Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.

Subject to the previous paragraph, JTWS will not be liable for losses arising solely from use of, or inability to use, this informational website where those losses were not reasonably foreseeable or were not caused by a breach of duty owed by JTWS.

If you use the website in the course of a business, JTWS will not be liable for indirect or consequential loss, loss of profit, revenue, business, contracts, anticipated savings, goodwill, opportunity or data arising from use of the website.

Liability relating to paid services is governed by the applicable client agreement rather than this website-use clause.

11. Privacy and cookies

Our Privacy Policy explains how personal information is handled. Any cookies or similar technologies are used subject to applicable privacy and electronic-communications law.

12. Linking to this website

You may link fairly and lawfully to the public homepage, provided the link does not damage our reputation, misrepresent a relationship or imply approval where none exists. You must not frame this website on another site or link from unlawful or misleading content.

We may withdraw linking permission where reasonably necessary.

13. Changes to these terms

We may update these terms from time to time. The revised terms apply to use of the website from the date they are published. Changes to an existing client contract require the process set out in that contract and are not made merely by changing this webpage.

14. Severability and waiver

If a provision of these terms is found unlawful or unenforceable, the remaining provisions will continue in effect. A failure or delay in enforcing a provision does not waive the right to enforce it later.

15. Third-party rights

Unless expressly stated otherwise, a person who is not a party to these terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce them.

16. Governing law and courts

These terms and any non-contractual dispute arising from them are governed by the law of England and Wales.

If you use the website as a business, the courts of England and Wales have exclusive jurisdiction. If you are a consumer, you may also have rights to bring proceedings in the part of the United Kingdom where you live, and nothing in these terms removes mandatory consumer rights.
